Overview -Digital Signature Certificate
A digital signature is a secure key (USB E-Token) that contains the signature in digital form and is used to validate and verify a specific person or entity.
Individuals and organisations both demand it. The key (USB E-Token) is generated in a secure media and is used to sign official documents online.
When a person or an entity needs to undertake statutory tasks online, such as submitting taxes or registering a business, a digital signature is required.
types of Digital Signature Certificate
Class 1
This class type is used to protect email conversations and is intended for use by both commercial and private individuals.
Class 2
This class type is utilised for entity incorporation, business registration, and income tax filing, among other things.
Class 3
This class type is used for E-Tendering or E-Auction participation.
Who requires a Digital Signature?
- Obtaining a Class 3 Digital Signature is mandatory in the following cases:
- Every registered trust, partnership firm, companies, and any other entity or individual who is subject to a tax audit under the Income Tax Act must file their filings electronically.
- Company filings with MCA21( Ministry of Corporate Affairs)
- MCA has mandated digital signatures for the following individuals:
- Directors
- Auditors
- Company Secretaries - Whether in practice or in job
- Bank Officials - for Registration and Satisfaction of Charges
- Other Authorized Signatories
When is Digital Signature required or mandatory?
Company Incorporation
If you’re forming a Public Limited Company, a Private Limited Company, a Limited Liability Partnership, or a One-Person Company, you’ll need a Digital Signature Certificate.
Obtaining Director Identification Number (DIN)
When applying for a DIN number, you must have a Digital Signature Certificate (DSC).
Ministry of Corporate Affairs (Compliances)
If your company’s yearly turnover exceeds INR 60 lakhs, you must use a Digital Signature Certificate to validate your returns.
Income Tax
It is necessary to file income tax with a Digital Signature Certificate for all individuals/professionals with an annual gross receipt of more than INR 25 lakhs and for enterprises with an annual turnover of INR 1 crore and above.
Goods and Service Tax
If you are a business entity (other than a sole proprietorship), a Digital Signature Certificate is required for both registration and online verification of GST returns.
Import & Export Code
When applying for an import or export code, you must have a DSC.
Intellectual Property Rights
